Gardeners Woodford Terms and Conditions
These Terms and Conditions set out the basis on which gardeners in Woodford provide gardening and related outdoor maintenance services to domestic and commercial clients. By making a booking, you agree that these terms apply to the service requested, whether the work involves routine lawn care, pruning, hedge trimming, planting, clearance, or other agreed garden maintenance tasks. Please read them carefully before confirming any appointment.
Booking process begins when you submit a request for services and provide the information needed to assess the job. This may include the type of work, access details, preferred dates, and any important site conditions. A booking is only confirmed once the service provider has accepted the request and, where applicable, a deposit or advance payment has been received. Any estimates given before confirmation are based on the information supplied at the time and may change if the scope of work is different on arrival.
When arranging a booking with Woodford gardeners, you are responsible for ensuring that the details provided are accurate and complete. If the property condition, size of the area, or level of work differs significantly from the information initially supplied, the price, timescale, or service plan may need to be revised.
Where access is restricted, equipment cannot be used safely, or the required materials are unavailable, the appointment may be delayed, rescheduled, or cancelled in accordance with these terms.
Payments must be made in the manner and within the time agreed at the point of booking or upon completion of the work, depending on the service arrangement. We may require a deposit to secure a booking, particularly for larger projects or appointments that involve specialist materials or reserved time slots. Unless otherwise stated, all quoted prices are in pounds sterling and may be subject to VAT where applicable.
Invoices are payable in full by the due date shown or, if no due date is specified, immediately upon receipt. The client must ensure that payment is made without deduction, set-off, or delay. If a payment is returned, declined, or reversed, any resulting bank charges or administration costs may be passed on to the client. Gardeners Woodford may suspend further work until outstanding sums are settled.
Where a fixed-price quote has been issued, it applies only to the work described in writing and only for the period stated. Any additional tasks requested on the day, or extra work needed because of hidden obstacles, waste volumes, severe overgrowth, or changes to the original brief, may be charged separately.
If the client asks for changes after the booking has been confirmed, a revised price may be issued and must be accepted before the amended work continues.
Cancellations and rescheduling requests should be made as early as possible. If you need to cancel a booking, the amount retained or charged may depend on how much notice is given and whether materials, labour, or vehicle time have already been allocated. Late cancellations can result in a cancellation fee, especially where the slot could not reasonably be reallocated to another client.
If the service provider must cancel or postpone due to illness, unsafe weather conditions, equipment failure, access problems, or other circumstances outside reasonable control, a new date will usually be offered. We will use reasonable efforts to complete the work as soon as practical, but no guarantee is given that an alternative appointment will match the original timing exactly. Garden maintenance services are often affected by seasonal and site-specific conditions, and these may require flexibility from both sides.
If a client fails to provide access, refuses safe entry, or does not make the site available at the agreed time, the visit may be treated as a late cancellation or missed appointment. In such cases, travel, labour, or call-out costs may still be charged.
Repeated missed appointments, incomplete instructions, or failure to cooperate with reasonable scheduling arrangements may result in the withdrawal of future booking availability.
Liability is limited to the extent permitted by law. The service provider will use reasonable skill and care in carrying out the agreed work, but no guarantee is given that all vegetation, pests, disease, regrowth, or underlying garden issues can be fully eliminated. Natural variation, weather, soil conditions, plant health, and prior neglect may affect results. Any estimates of outcome are not a promise of perfection.
The client must tell us about known hazards before work starts, including hidden drains, fragile structures, buried services, aggressive animals, unstable surfaces, or any other condition that may affect safe performance of the services. The service provider is not responsible for damage caused by information that was not disclosed, by pre-existing defects, or by the failure of the client to secure valuable or breakable items in advance. This applies to work undertaken by gardeners in Woodford and by any subcontractor acting on instructions.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under UK law. Subject to that, the service provider will not be liable for indirect loss, loss of profit, loss of business, or consequential losses arising from the use of the service.
Any claim relating to damage, service failure, or incomplete work must be raised within a reasonable time after completion, so that the matter can be investigated promptly.
Waste regulations apply to all green waste, soil, timber, cuttings, and materials removed during the provision of garden services. Unless expressly agreed otherwise, waste produced during the job remains the responsibility of the client once it has been placed in the agreed collection area, loaded for disposal, or handled according to the service arrangement. If removal and disposal are included in the booking, waste will be managed in line with applicable environmental and licensing requirements.
The client must not ask the service provider to dispose of prohibited, hazardous, or contaminated materials unless this has been specifically agreed and can be lawfully handled. Such items may include asbestos, chemicals, oils, medical waste, sharp metal, and any material that requires specialist disposal. If restricted waste is discovered during the job, the work may be paused until appropriate arrangements are made, and extra charges may apply where lawful and reasonable.
Any green waste transferred for disposal will be handled with reasonable care and in accordance with relevant UK waste duties. We may use licensed carriers or authorised facilities where required. The client is responsible for ensuring that the waste presented for collection is accurately described. If unlawful, misdescribed, or mixed waste is supplied, the client may be liable for any resulting losses, fines, or disposal costs incurred as a consequence of inaccurate information.
Client responsibilities include providing safe access to the property, obtaining any required permissions, and ensuring that pets, children, and vulnerable items are kept away from the working area. The client must also ensure that water, electricity, or other facilities needed for the agreed service are available if they are part of the job. If the site is not ready at the scheduled time, the visit may need to be rearranged.
Materials, plants, and seasonal supply may be affected by availability, weather, and market conditions. If the service includes the purchase of plants, compost, gravel, turf, or similar items, substitutions may be proposed where the original item is unavailable. Any substitution will be of comparable quality where reasonably possible, but exact colour, size, maturity, or finish may vary. Clients should understand that living materials are inherently variable and may not perform identically in every setting.
Gardeners Woodford may use trained staff, approved contractors, or subcontractors to perform part or all of the services, provided that the overall service standard remains reasonable. The client must not interfere with the work in a way that creates a health and safety risk. If the client asks for work to continue despite obvious risk, the service provider may stop work immediately and may charge for time already spent on site.
Complaints and remedies should be reported as soon as possible after the issue arises. The service provider may ask for photographs, written details, or access to the relevant area in order to assess the concern. Where a genuine error has occurred, the usual remedy may be a return visit, repair, adjustment, or partial refund, depending on the nature of the problem and what is reasonable in the circumstances.
If a dispute cannot be resolved informally, both parties agree to act reasonably and attempt to settle the matter in good faith before starting formal proceedings. No term in this document prevents either party from using any rights or remedies available under UK consumer law or contract law. The client acknowledges that gardening services may involve seasonal outcomes and that not every disappointment amounts to a breach of contract.
These Terms and Conditions are governed by the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction over any dispute arising out of or in connection with the services, subject to any mandatory legal rights that apply otherwise. By booking garden maintenance services through this service, you agree that these terms form part of the contract between the parties and apply to each confirmed booking unless amended in writing.
